Eea efm

Post by Liv__xx » Sun May 17, 2020 7:28 pm

Hi guys hope you are all well and safe!:)

I am wondering my case will be accepted or not...

I’d like to apply EEA EFM visa and I’ve been living with my Irish boyfriend in London at the moment.

We lived in Ireland Feb - May 2016 (4months) and my visa expired so I had to go back to my country.
And I got an working holiday visa so we moved to London Mar 2019(15months). Since then we’ve been living together.

My concern is we had a term between Jun 2016 - Feb 2019 because I didn’t have any visa so could’t find any option to live together.. so we had a holiday once or twice per each year.
And another concern is back then when we lived in Ireland, We don’t have good evidence.. we have only 2 e-receipts on my name and his family house address and 2 witness letters. That’s all I have evidence back in Ireland.

Since Mar 2019 we have enough proof evidence such as council tax bill, gas bill, water bill, ni letter, tenancy agreement, joint bank account and etc..

Guys I don’t want to pay for solicitor but any idea we might get refused eea efm visa..?

It sounds like you have a decent argument to justify an eea efm visa as an unmarried partner. The EEA legislation only states that your relationship must be 'durable' which is up for interpretation and does not necessarily mean living together for 2 years (especially if you were unable to do this because you can't live in the same country easily!) Seeing as you have been together for several years, maybe you moved back to the UK to continue the relationship and have been living together for more than 1 year, it sounds like you have a strong relationship and it is definitely worth applying.

The fact that you visited each other once or twice a year shows a level of commitment to the relationship, so definitely give all the travel receipts of this. I also suggest showing logs of chats/Skype calls/photos during the time you were living long distance to improve the evidence.

Best of luck!
