Am I Still entitled to Work after my EEA FP Expires

Post by hashimmod » Mon Jan 11, 2010 6:45 pm

Dear sir,
I hold a EEA Family permit which was valid from 18-6-2009 and got expired on the 18-12-2009 and i am in UK with my french wife and my employer has dissmised me from my job saying that i am not entitled to work as my EEA family permit has expired on 18-12-2009. But the british embassy and the home office said that it is not a must to have a Residence card as long as i live here with my EEA wife i have the right of residence. but my employer dosent agree with that and dont want me to take back at work without a residence card. What can i do sir ? i would appriciate your advice it would be of great help.

I would like to thank you in advance.

have you applied for your 5 year resident card ? if yes, then the letter you recieved from Home Office as acknowledgement should mention that your status remains the same till a decision is taken on your application. You can prodice that letter to your employer.

hashimmod, your employer is taking a huge risk, and facing an Unfair Dismissal claim from you!

But as already asked, have you applied for your Residence Card? If so, have you received the CoA letter ..... confirmation of application?

Civil partnership certificate? I thought you were married?

Perhaps they're the same gender! :?:

@ OP.. Do you mean 'marriage certificate' as opposed to 'civil partnership'?
