EEA non National how his famil can join him

Hi,

Hope someone can help me.
My friend ( non EEA national) has a permanant resident card. Applied under EEA2 form as a family member of a EEA national.

But his wife and child are in Sri Lanka and want to join him. Can he sponsor them and if so what form should he use?

They are really desperate and any help will be much appreciated.

You need to give more information.

As your friend is apparently not the spouse of an EEA national, then what is the family relationship?

If the wife and child in Sri Lanka would qualify as family members under EU rules, they would first of all need to apply for an EEA Family Permit at the British High Commission in Sri Lanka (using form VAF5).

He first came into this country as a dependent of a EEA national. EEA national is his sister and family. and was working here ( he was allowed to work) now he has the PR card.

So to answer your question the EEA national is his sister and as he is a family member is being given PR card till 2010.

But in the mean time he has got married and now they have a child.

I have tried to search in the internet for details etc and not clear where to get some information.

If you can put me int he right direction that will be really helpful.

Also can I calrify. my fireld ( who is trying to get his wife and child from Sri Lanka ) although has a PR card, is not a EEA national.

EEA4 form, talks about family permit for families of EEA nationals
will the same form apply.

I am very surprised that your friend got a residence card in the first place.

For extended family members (like himself) the rule is that they must have been dependent on the EEA national already before the EEA national came to the UK.
From your story this seems very unlikely for his wife and child, and I don't see how they can come to the UK on the basis of European law.

That's not possible because permanent residence cards have only been issued since May 2006. A PR card is valid for 10 years. So what exactly is it? (EEA2 and EEA4 are only identifiers given to application forms.)

I also don't see how EEA regulations would apply to your friend. If he really is a permanent resident then he should be able to bring over his family but this question is probably better answered here.
