Hi guys, I just realised that when my solicitor submitted my EEA4 form, she never mentioned travelling section and im sure she hasn't filled it, how bad can this be?
Would they refuse my application or just return it to us and have to fill it and resend it again?
Any information would help, thanks guys.

Application cannot be refused because the form wasn't fill in completely.

The HO would either ask for more information or be satisfied with the evidence you provided. To qualify for PR you can be absent up to 6 months a year so I wouldn't worry too much about that.

may be is better if you fill the eea4 application again and send it with cover letter explain the missing section(you can't send only the missing part because of your signature and date at the end of application).

how they can be satisfied if they don't know how long has been outside UK,they will not bother to check his time out from work for 5 years for example.

Thanks guys,,, is this absent its just for non EEA(applicant) or both(NON EEA'EEA) im (non EEA) only the applicant.
Also I only have travelled twice a year(10 day or 1 week holiday) last two years only, and I have entry and exit visa on my passport anyway.

Surely the HO has its own ways to verify if someone meets the requirements other than relying on what the applicant filled in a form which is not even mandatory.

The HO asks for evidence to prove residence and will ask for more evidence if this is not enough. Filling in some lines in a form is not proof.

The residence requirements are the same for both EEA/non EEA.

Hi Jambo, so although only I (non EEA) have applied for PR but HO still needs to know both of us absent time from uk? or just me?

So what do you think,,should i wait for HO see if they ask me about travelling section's more information or should I just fill this section in a new application and send it to HO along with an explanation cover letter?

You are the only one that can decide. I don't know what the UKBA will do. What you've been told already is that this is a relatively recent addition to the form (it was not asked for before) and that the form is not mandatory.

You may get a request for additional information, you may not.

Why pay a lawyer for a form that's pretty simple to complete, especially if they didn't complete it?

Thanks EUsmileWEallsmile, the solicitor was free I think i will speak to my solicitor on Monday then decide,,,, I believe it shouldn't be a problem as I have sent the all payslips so HO would know that we haven't been absent mush from UK. only 2 short holidays a year.

Nice to get a free solicitor. Your point is the same that I made in the thread I sent you. Six months is a very long time to be absent. Most people who work in the UK will not get such extensive leave. Most people will remember if they were out of the UK for a long period of time, many people will not remember the specifics of their holidays, but will know that they were relatively short.

I wouldn't worry too much about it.

I personally would write a letter. On it provide the information that was omitted from the form, namely "Absences from the UK between STARTDATE and ENDDATE". Explain that "As the Residence Card application can be submitted in any format, this letter forms part of my application".

Hi Directive/2004/38/EC, thanks for advice,,I spoken to my solicitor and she said that wouldn't be a problem as long as the other documents are ok and besides I haven't had a holiday longer than 6 weeks and that will be seen as a visa on my passport but no visas on my spouse passport as she is EEA national.
