Application for EEA FP Vienna - Update: FP granted!

Hello everyone,

My wife has an appointment at the British Embassy next monday. This is her second application for an EEA FP already. The first was refused in 2010 because they were not satiesfied that I am an EEA national. My wife did bring along my passport but apparently the people at the Embassy did not send a copy of it to the UKBA. So this time I want to make it right because we both want to travel to London this July for one week.

Short summary: I am an Austrian citizen and my wife is a Vietnamese citizen. We are married since 2006 and live together in Vienna.

So what documents are required for a successful application? What does "a copy of the EEA national's passport, endorsed by the EEA national's embassy in the country of application" means? Any help/advices are much appreciated.

Best regards :)

I see. So only our passports, marriage certificate and a letter should be enough. No further documents needed? I am just afraid of another refusal. The people in Warsaw are difficult to pleased i heard. It is a real shame that a spouse of an EEA citizen has so many difficulties.

If it was refused on the basis you say, did you not follow that up? Did you complain?

As far as I remember we didn't have a right to appeal. Also my wife was very disappointed because this was her second refusal already. The first time she applied for general visitor visa because we didn't know about EEAF FP back then.

Thanks for the helpful links. I found a letter on this forum and changed it a little to my needs. Credits to haringnl83.
To whom it may concern (Dear Sir or Madam???)

Please find enclosed the application for an EEA Family Permit for my wife [name]. We plan to travel to the UK together on July XX, 2012 and return to Austria together on July XX, 2012. According to The Immigration (EEA) Regulations 2006 sections 12 and 13, the following documents are provided with the application:

(1) [wive's name]
- application form completed and printed
- her password and residence permit
- our marriage certificate
- 2 photos
- copy of my Austrian passport
- residence registration form as evidence that we live together

Copies and translations of the above documents have been included, in addition to the originals.

I understand that under The Immigration (EEA) Regulations 2006 section 13, my family member and I have an initial right of residence for a period of 3 months.

This is an application under EU law and I understand that it will be processed as soon as possible and on a priority basis.

Sincerely
Do you think that this is suffient? Is a copy of my passports detail pages enough? Is a certified copy needed? Please help me, my wife has an appointment at the UK Embassy tomorrow. Thanks

Your letter looks fine to me. You should include a reference to the previous rejection.

I supplied the original passport. I am, however, still waiting for a reply.

Thanks for the advice. We've been there today. Very quick procedure. They only needed a copy of the EEA nationals passport. In about 14 days we will know more. :)

This is a very strange story. Did they give you a refusal letter in 2010? What exactly did it say? Who told you the part in bold?

Glad to here that (certified copy could be a real pain).
