Hi , Iam Turkish national living in uk for 11 years.I came to uk in april 2011 and i had been on a student visa until november 2005.I got married in december 2005 with my husband(He is polish)and came back to uk with a family permit in 2006 i have applied for residence card and received it which is valid until june 2012.Due to my husband out of work between 2008-2010 and not having comrehnsive sickness insurance i am not able to apply for permanent residence in uk though have been living in uk for 11 years.My question is is it possible for me to apply under ziolkowski case?Is there any possibility that they can count residence i uk under student visa(2001-2005)towards permanent residence.Also note please my husband was working between 2005-2008, total 3 years and we are still married.

Was your husband in the UK before 2005? Did you live together before you got married in 2005?

Another option is to apply for ILR under the 10 years rule.

He was in UK on a student visa (NO CSI or ehic card).We start to live together when we got married not before.Do you think am I still eligible to apply for 10 years even he was out of work for two years (between 2008-2010)?

My mistake. You are right. You can't count those years for 10 years if you can't count them for PR.

Your husband might apply if he had completed 5 years before 2008. Time as student counts. There is no requirement to have CSI on a student visa.

If he had obtained PR in 2008 then it doesn't matter he was unemployed and had no CSI. This is not required to keep the PR status. In that case, you could apply for PR.

So basically it depends when your husband started to live in the UK and if he completed 5 years exercising treaty rights before becoming unemployed in 2008.

just want to ask a quick question
am a family member of an eea national(my mother)i will be 23 when i apply for my PR next year.i didnt want to send all 5yrs bank statements with the application so i was thinking of getting a headed letter from college and banks saying the year i was with them or must they show my addresses as well or it does it matter,is my age going to be a problem.thanks in advance.

You don't need to send bank statements if you don't want to. If you have utility bills under your name or a letter from the college stating you have been attending classes as a student that should be good enough. All you need to prove is that you have been more than 6 months a year in the UK.

Any lawful stay in uk count toward ILR
