EU PARTNER PREVIOUSLY MARRIED AND NOT DIVORCED

I was on a student visa and applied for a EU Residence Card after marrying my French partner.

My application was refused and my documents held as it turned out that my partner is still legally married to someone else; I was never aware until I read my refusal notice from the UKBA.

The relationship turned sore and we broke up after a massive argument. My partner disappeared into thin air after this and left me in confusion.

My stay as a student has expired, I am without any travel document and totally depressed and devastated.

I have no idea of what to do or where to start from.

Please advice me.

You are not legally married to an EU national and do not have valid leave to remain in the UK. Based on those facts, you would need to apply to the consulate of your country for a new passport and then leave the UK. Good luck.

The ukba have her passport. If you wish to leave the UK then you can contact them to make the necessary arrangements. If you are still studying then you should seek advice on whether you meet the requirements to make a new tier 4 application.

If the UKBA do have your passport then have they retained it and given you enforcement instructions?
