EEA2 for a "tourist"

I'm asking on behalf of someone else, this person entered the UK as a tourist (she is not a visa national), with her EEA national husband. The husband is working full time, but her 6 months are coming to an end.
Can she apply for EEA2 residence? I couldn't find anything about needing a family permit before applying.

For the benefit of others -
* EEA Family Permit is not mandatory
* EEA2 application can be made regardless of immigration history/status.
