Based on C/424/10 Ziolkowski et al v Berlin_Applying for PR

I am an A2 national, resident in the UK since 1997.

My question is:

Based on the ECJ ruling in the case of Ziolkowski et al vs Berlin C/424/10 and Sieja C425/10, can one apply for PR card retrospectively for the time spent in UK under the EC Association Agreements (2003-2007) plus additional time (2008-2010) time as an employed A2 national with blue card exempt from worker authorsation scheme? I am currently temporarily unemployed (full-time mother) but seeking to return to work soon.

Please also note that a First-Tier Tribunal has ruled that I kept my status as a worker (that is after Dec 2010) due to unfair dismissal.

Please, I am looking for some advice regarding the following circumstances, I would appreciate if someone could point me in the right direction:

Please note that between 2003 -2007 I was a self-employed person in the UK under the EC Association Agreements. In Dec 2007 I obtained a Blue Card reg. cert. as exempt from worker authorisation scheme. I subsequently found full-time employment (2008-2010).

The HO announced amendments to the EEA regulations which would come into force in mid July. They will include the effect of ECJ ruling in the case of Ziolkowski. See point 25 in SI 2012/1547.
