ILR Application in UK – Hungarian Spouse- unspent conviction

Hello All,
I am an Algerian national and my wife is Hungarian, I currently have a 5 years residency in the UK as a family member of an EU national (my wife) So this was through EU Law. I have a conviction which will be spent 1 year after my application for ILR will be due. My solicitor is telling me that the conviction won’t affect my ILR application because I will apply through EU law and not UK immigration law. I am still worried.
Your help would be really appreciated. Moderators/Senior Members, please advise.
