My Son was refused entry visa for EEA family permit,reasons,no enough evidence he's my biological child.Went for an appeal which i lost,Judge said the only way to settle the issue is undergoing a DNA test.
Recently we undergo a DNA test and result was positive,email the embassy i was advised i need to re apply submitting supporting documents.My question is this,Me and my EEA family claims Tax credits,child Tax Credits and Child care,will this affect my application?Am a Nigerian married to a European citizen living in the UK 5 years and holds a residence card.

What age is the son? If under 21, then he can come as a member of your family, if over 21 he would need to be dependent on you.

From your post, I take it that your EU spouse is living in the UK are they working, self-sufficient, student or do they have permanent residence. Please clarify.

He's 14 Years old,my EU spouse is working,lived here 5 years as well but don't have a permanent residence.Thanks for your reply

Ok, 14 is good. The evidence you require is:

1. His passport.
2. Evidence that you are related (DNA test now done).
3. Evidence that you are married to your spouse.
4. EU spouse's passport (copy)
5. Evidence that she is living in the UK under the 2006 regulations, worker is fine. Employer's letter is good.

If you are making the application while he is abroad and you are in the UK, then photocopies of the biometric pages of your passports are find.

Many thanks for the feed back,already had everything ready,everything on the list provided,was just worried if because we claiming Tax credit that might affect the application.Though am sending just my spouses letter from work no pay slips or Banks statement and a passport copy..mine is pay slips and everything as written on the lis

It is your wife's employment that matters. An employer's letter is fine.
