Applying for an EEA2 R-card whilst in UK on a visitor visa

Hi folks,

I am from New Zealand and applying for this via my wife (UK/Irish passport holder) while in the UK (Northern Ireland) on a visitors visa. We were married in the UK four years ago but have since been living in NZ. We have come back swiftly on account of her mums health and would like to remain to work/live/support family. We have no desire or intention of claiming any public funds, we have private health insurance, decent savings and a rental property in NZ proving this.

We just simply want to live and work here, we had our first child 7 months ago so my wife is not going to be working for at least another 5 until breast feeding ceases and she is also spending a lot of time caring for her mum. We are both however professionals with a provable track record and hoping we will be granted this card so as I can work and begin to settle here.

We are putting together a heavily laden application (before the 16th of Oct) but are very concerned about the outcome and time frames involved. At present we've been advised we are likely to be denied but an appeal could be favorable.

Any advice or info would be hugely appreciated!

Have you been in the UK on 16th July? Although the change come into force on the 16th October, the legislation requires you to have been in the UK already on 16th July.

Ah no only arrived on the 8th of Aug.... oh dear.. do you think this means I am likely to be shunned right out of the gate ?

And no the application isn't under SS

See schedule 3 for the transitional arrangements which I don't believe you fall within.
