EEA4 and Change of Circumstances

My PR application has been with the UKBA since 16 Oct. '12 and my husband will officially become a BC on 19 Dec. '12. If my PR confirmation does not come through before Hubby becomes British, do I need to inform the UKBA of this change?

I cannot see why this but want to bounce off others in case i've overlooked anything.

How strange that this very scenario flashed through my mind with the same cast member! Such predictive precision I have!

Seriously though, the PR form does ask the question whether the EEA family member is also a BC and I imagined that the UKBA might still want to know if it happens while the application is being processed.

Can you ruminate over this again w/out the temptation to copy and paste? :wink:

Assuming you actually qualify for PR, you have acquired it automatically already. The purpose of your application is only to let UKBA formally confirm this.

Anything what happens after you have acquired PR is therefore irrelevant, will have no effect on UKBA's decision and does not need to be reported to them.

I apologise for being predictive ;-)

But I believe you already knew the answer before asking.

The form asks to be informed in case of "a material change in my circumstances or new information relevant to this application becomes available". I don't think your partner becoming a BC after the application has been sent fits that criteria.

I think this is the right answer. You already have PR. You've only applied for the confirmation of it. Given that when you submitted your application you fulfilled out requirements, I don't see why you would need to notify the Home Office.

Your husband has exercised Treaty rights for at least 5 years. The fact that he's now becoming a British citizen doesn't change the fact that he has exercised such rights. They ask in the form due to the fact that you can't exercise Treaty rights on your own country, except in certain circumstances. It's more to invalidate the period on which you're affirming your husband has exercised Treaty rights. Given that he did in fact exercised those rights, nothing changed.

Guys I wouldn't waste anyone's time unnecessarily if I already knew the answer to the question.

I admit that I didn't think it through thoroughly and probably was just fixated on this part of the form which asks about British Nationality for the EU FM, and assuming that it was still relevant beyond this.

I appreciate all your comments - cheeky, helpful and clear. :)
