Please help!:)Family permit for Aussie married to a Romanian

Hi I am an Australian Citizen who has been residing in the UK for almost 2 years. Since coming to the UK i have met my partner and we have been in a relationship for 10months. We have been living together now for 4 months- both sharing rent and have gone on many holidays together, met each others family etc. I will be applying to return to the UK to join him on a EEA family permit as i don't want to risk overstaying my Visa when it expires at the end of December. The problem is we would have only been married for a month once at the time i leave.
What i would love some advice on is:
-Can i apply for a EEA permit without leaving the country?
-What is the waiting time on an 'in country' EEA family permit application?
- Will the application need to be different as he is a Romanian National?
-Will our application look insincere as we have only been married for a short time and the application was made just prior to my current visa expiring.
We are however in a very real relationship! And have lots of photos and a shared lease as proof, is this enough?
Please any advise would be so helpful :)

What is your patner doing in the UK? Working, studying? Does your partner hold a residence card from the HO (yellow or blue)?

There is no need to leave the country and application can be made in country. You won't become an overstayer.

I agree. In fact I usually think it is a mistake to leave the country.

Just get married and apply for a Residence Card. Get on with you life!
