Hi,

My partner is Indian and I am British. We have a child together. He has to return to India in February and we wondered if he can apply for an EEA FP from India to join me in the UK again, marry, and then leave for Spain where we want to settle as husband and wife.

Any help appreciated.

You cannot apply for EEA family permit, because you and you husband have never lived in another EU memberstate before, where you resided as a worker or self-employed person. You can however get your husband to apply for entry in Spain, once you are there.
