Zambrano application, son's British passport expired

Hi everyone,
Please can someone suggest to me what to do? I made a Zambrano application in November 2011 and submitted my son's British passport which was valid then. It has since expired in November 2012. Before expiration though, i told my solicitor to request the passport back for renewal but she suggested against this. After receiving the new forms from the Home office, i realized they used the word 'valid' ID for the British citizen as one of the documents required. My worry is that if a passport expires, its no more valid, so suggested to my solicitor yet again to request passport back. Again she said not to worry because they would realize the passport got expired in their possession. I don't want them to refuse and further delay the application. What should i do? Am really anxious.

Well i don't think that will be a problem. At the time you made the application there a valid passport was supplied. It is not your fault that they took 14 months, and now the passport is expired. I don't think refusing on this basis will be justified. The fact is the child is a British Citizen, a passport merely confirms this, it does not confer such rights.

It is not a good idea to ask the passport back, for the fact that your child's passport has expired does not make him/her less british or not British at all. Your solicitor is right for not requesting that the passport be returned. Decisions on Zambrano applications should be imminent

Thank you Obie and Prince74 for your speedy responses. I can now breathe easily. The waiting game is so nerve wrecking and making me paranoid. I pray this journey of ours ends with a positive news from the HO. Once again thanks!
