EEA3 Application and Job seeker

hi,
I applying for eea3 as i am completing my 5 years where I was working, but the problem is i was on job seeker for 2 and a half month. here is my details

feb 2008 to june 2009 working (employer 1)
june 2009 to aug 2009 claiming job seeker
aug 2009 to nov 2010 working (employer 2)
nov 2010 to july 2011 working ( employer 1)
july 2011 to till now working employer 3)

now the problem is ukba may refuse my application as I claimed job seeker for 2 and a half months as also claimed public funds.

as i was reading on forum that someone refused firstly he claimed job seeker for more then 6 months and then they said u claimed public funds, so can someone help what is definition for job seeker

It should not be an issue i believe.

You retain your status during the second stage.

You shoulf be fine.

well yes that what i was thinking but lot of confusion as i was reading on forums that they normally refuse job seeker application and simply say you were claiming public funds. plus if you read job seeker definition under Regulation 2006 paragraph 6 section (4) For the purpose of paragraph (1)(a), “job seeker” means a person who enters the United Kingdom in order to seek employment and can provide evidence that he is seeking employment and has a genuine chance of being engaged.
so job seeker only treated if he claims when he enter the uk not afterwords???

Please help
