EEA Permanent Residence

I want to know about five year Residency Requirement..If a person came to uk on Student visa and then got a residence card..the time he/she spent in uk with tier4 visa status counts toward permanent residence or not.. if he/she has been living with EEA Family member for this period and that EEA family member exercising his/her treaty rights during this period.

Tier 4 relates to uk immigration category whereas EEA2 RC alls under EEA law. Tier4 time cannot be counted towards getting PR under EEA law.

It depends if you are married to the EEA national or not.

If married, time is counted automatically from the moment the EEA national is exercising treaty rights regardless what visa you hold (if any). If not married, time only counts from the date you have been issued a residence document under EEA regulations (EEA FP or RC).
