Hello,

I am non-EEA national. my husband is EU national. he has been continuting working for 5 years in here.

at the moment, his passport is expired, can I use his Greek ID apply EEA4?

Also may I apply EEA3 for my son with my EEA4 at the same time? he is 4 and half years old and is holding a Greek passport but was born here and living here with us.

Does my husband need to pass the life in the uk test to apply EEA3 to get PR (permanant Residence)?

Looking forward to your advise.

Many thanks,

Mae

Most definitely yes, as per UKBA forms.

Yes. The form asks for a passport or ID card.

He can apply if you apply after (or very close) he is 5 years old. He can't get PR if he is younger than 5 (as he didn't live for 5 years in the UK). In any case, PR for a EEA child is meaningless. He doesn't really need it. It is not needed in order to apply for British citizenship (if this is the reason you seek PR).

No. For EEA national this is only required if applying for British citizenship.

There is no need for the EU citizen or the non-EU family member to do anything regarding the Life in the UK test for their PR.

They only need to do it later if they decide to apply for naturalization as a British citizen.

Thank you very much!
