Date of application: 07/06/2012
Application received: 08/06/2012
COA received : 16/10/2012 (after MP got involved)
RC:??? Still waiting
My wife is an Eea national. She is a divorcee. We got married in feb 2012 in Ghana and i entered the uk on an Eea family permit. Prior to that we were living in uk for 8 yrs.(together for 4yrs) I was an overstayer for5yrs so we went to Ghana to get married. It took 4mths to get COA. After 7 months of application I requested for the return of my documents. I received passports and other documents back but without residence card . Earlier on I had written to ukcustomercomplaints about the delay and it took them 3months to respond stating that they are still carrying out enquiries on my application. I have called ukba in numerous occasions and I always get told I should carry on waiting. It's over 10 months now and no sign of the RC or letter asking me to send my passport back as I still have it. I just don't know what's going on and what to do. It's been very stressful and I wonder what kind of enquiries can take this long? Somebody help please!!

Hi there! I just wanted to let you know that your alone. Cuz am in the some boat like you Mr. Is sent my application on the 28 may 2012. After 3mths i received my COA with right to work. To br honest thats the last time i ever had from them. I have written letters, emails, sent faxes, called them almost every month but this no luck. In feb 2013 my MP wrote them on my behalf and got no reply.
So last month i decided to write to Rob whiteman Chief Executive UK Border Agency and last week i got this reply:
Hello,
Your email has been passed to me to respond as the lead for European Casework. I am sorry that the application has not been dealt with as speedily as it should have been but I can confirm that it is now with a caseworker to make a decision by the end of the week.
We strive to provide a first class service and it is a matter of regret when we fall short of the highest standards, please accept my apologies.
Thanks,
Margie Clarke

Freemind and Kixmug, if you are both still waiting for a long overdue confirmation of your rights of UK residence then, in addition to involving your MP(s), you may also wish to petition the EU Commission to investigate and summon the UKBA to account for these substantial processing delays.
