An EEA national worker/self employed person can claim public benefits and for determining the PR then the individual circumstances are being considered. Only an EEA national cannot become self sufficient on public benefits.

If she has PR then she is now free from exercising treaty rights. Therefore, you just complete your 5 years and apply EEA4 PR.

hi hunpak,
my wife was pregnant after 4 yrs, she received maternity allowance but after it finished i made her to claim jobseeker allowance, to show that she is actively looking for job. But I wanted her to take care of the baby. Also explained in a cover letter that we support each other financially (me working too). Showed some bank statement of transferring money between our banks. I got my PR today (with nearly 1 yr gap of my wife not working!)

Congratulations on your PR, I can't wait for mine. The way things are going in uk I am worried all the times that laws will change.

If anyone has any idea to help me out here please do so. I have been living in the UK for the last 10 and half years. I was married to an EU (French ) national almost 5 and half years ago and got 5 years resident card, which was expired few months ago.
Now few months ago I had an accident at work in which I lost my eye sight in one eye I got 16 stitches inside, I am on compassionate leave which means I am paid my full wages 2000 pounds a month. But my wife can not work due to my condition she has to take care of me and I get nervous at time. I can not cope with my condition my finances are get up and can not afford to live in the UK without financial help. My solicitor told me my claim worth 100s of thousands as it was my company's negligence but right now I can not live without benefits.
I am afraid my application for benefits can affect my currant application of PR and future application of BC, I am not in right condition to make any decision. Can any of the expert on this forum advice me if I can apply for benefits without any affect on my application for RP or BC or I have to go back as I can not afford my situation right now.
Thanks alot

You should make a claim for Industrial Injuries Disablement Benefit and Personal Independence Payment.

If your wife had been working in the 5 years preceding your accident, then you have right of Permanent residence. What subsequently transpired ie your accident or the break to look after you is not material.

My wife is a teacher her history is
2008 to 209 teacher assistant,
2009-2010 teacher training paid with CSI.
We also started a business from 2007 to 2010 and turned around 20500 pounds before stopping the company.
2010-2013 teaching in embassy and council,
then teaching as self employed and website online teaching,
now teaching in reputable company with online teaching.
During all 5 years job application for permanent teaching job in a school.
There are few gapes here and there
but I have applied for RP and fees are taken out of my account and today on 30th I got letter from HO dated 25/06/2012 saying they received application EEA.
I am having job of almost 2000/month which is still paid but my wife is not working due to my injury, will it affect my PR or BC please
