2012 amendments to the 2006 Regulations (McCarthy C-343/09)

Anyone any experience on the 2012 amendments to the 2006 Regulations, regarding a person holding dual citizenship? Specifically EEA nationals born in Northern Ireland who have dual Irish/British citizenship and how this has affected applications since its introduction?

I am a non-EEA national who is a family member of an EEA national with Irish/British citizenship but it was through the use of the Irish passport that i obtained 5yr residency in 2008.

I am now completing the EEA 4 application and was wondering
1. how this would affect my application
2. whether you need to state that family member also holds british passport?

1. No affect. It only affects new applications. Not existing ones.
2. I don't see why not as there is a specific question asking that (although there is no mandatory requirement to answer it).

Did you have any problems with your application ? I realise that you were successful I am in a similiar position Irish/British citizenship born in the UK. Husband already has EEA2 about to apply for EEA4

I am just trying to anticipate any problems as the UKBA helpdesk couldn't give me a clear answer.
