EEA2 APPLICATION REFUSED REASON WIFES PASSPORT REPORTED LOST

Hello everyone,
On Friday the 12th of July my application for residency card and my wife's application for residency certificate was refused based on her Identity not valid. UKBA claims that her passport was reported lost so therefore she is not a valid European citizen.She lost her previous passport that was reported lost but she got a newone and we used it to apply for EEA 1 AND EEA 2, they have not given us the rigth of appeal.

What do we do? is clearly a mistake from them so we have been refused based on a mistake.

TIME LINE
EEA 1 AND 2 SENT DEC 21
RECIEVED DEC 27
COA RECIEVED FEB 11
APPLICATION REFUSED JULY 12( DATED JULY 7)

Ask them to reconsider their decision, provide evidence that this passport is a replacement for the lost one, or alternatively provide a valid ID if one is available.
Tell them you will seek Judicial review if they fail to do so.

I will do that. How long does a judicial review take should in case the home office are reluctant to turn their decision.

Has anyone done a JUDICIAL REVIEW HERE?

In the circumstance of your case, there will be no proper defense that they could raise against your case, so i dont think it will take long at all.

The decision is simply wrong, as no proper checks seem to have been undertaken to ascertain the authenticity of the passport.

i will do that, im going to see my solicitor today and i will let you know what steps are being taken. HAS ANYONE HAD A SIMILAR CASE TO MINE? will like to know what steps they took and results gained.
