Hi, all. Here is my timeline:

EEA 2 RC Application submitted - 01/05/2013
Application Received - 02/05/2013
Confirmation Letter - 07/05/2013 (no right to work. unmarried partner)

Still waiting on RC

I asked for my passport back and received it on May 14 so I could travel to the US to finish a masters program. I am still here and will be here until my flight back to the UK which is the end of September. What I am worried about is getting back into the UK...if I don't receive my RC by then will I have issues at the border? I can't apply for an EEA family permit because all of the evidence needed for that is currently with the UKBA for the RC. Thanks for the advice.

As a US citizen, you will have no problem boarding a flight. Once you get to the border, just show the CoA and that would be enough.

Immigration wise - not an issue.
Airline wise - probably not an issue.

Are you using the return leg of a return ticket? Or are you purchasing a new one way ticket? I don't think it would matter but the former is normal practice for residents so might attract less attention (although as I said both would be OK).

yes it's the return leg of a round trip ticket. So upon arrival I show the immigration officer COA and say that it is my intention to stay until I get the permit and to leave otherwise?

Just show the CoA and say you have an application pending with the HO. There is no need to explain what you will do "in case of". If the HO refuse the application, you will normally get right to appeal but all of this is not relevant to the discussion in the border.
