Hello everybody, Im asking you some information about EEA2 Unmarried partner Visa for my friend.
He's been in the UK from 3 years on a Student Visa and now has an italian girlfriend and they are living together since January.
Since his visa will expire on February 2014 is it going to be useless if he would apply for an eea2? Cause they dont have proof for 2 years..
Is there anyone who got it from less 2 yrs proof?
Please give some advice.
Thanks in advance

I would assume they are fairly strict on the 2 year condition and will probably refuse the application. I have read another post in which someone was adviced by UKBA that he/she could only apply 28 days before the 2 year mark. What about a post-study visa?

What about getting married and applying for EEA?

That would of course work but it's a big decision

miryferny, the problem is that the regulations say that they must be in a "durable relationship", and UKBA interpret that as needing to live together for at least two years.
However it seems to me that it is totally possible for a relationship to be durable before two years has elapsed. So they might consider applying for a Residence Card, getting refused, then appealing and taking a chance before the Tribunal.

Well that would buy him some time I guess but would still be messy. I would look into other visa options first and use EEA2 as a last resort.
Tbh, we are having so much stress with our application we wished we had applied for a different type of visa instead.

yeh but if it's going to be rejected can he appeal? coz he might be classified as an overstayer?
