Financial situation of the EEA sponsor

Hello thank you for the great info and support from here.

Could anyone help to clear my question.

Is there any official law to require a certain financial conditions for the sponsor for EEA family member from third country.

Let's say, a sponsor wants to bring his dependent parents to live with him:

1. For the case of Self-employed. Does he needs to prove his income from the business is big enough to cover the living cost for 3 ?
(If no, then the sponsor just needs to show his business is on trading?)

2. Same question for the case if the sponsor is working. If his salary is about 1,5 minimum wage, would this leads to refusal as this is not enough for the living of 3 ?

I mean how this applied in EU wide, not only UK.

Please advise!

No financial requirement. Only that the conditions of being a family member are met.

The same for extended family members and dependant relatives.

Financial requirements only come into play with Self Sufficient applications. but a worker can claim top up benefits...

I'm sure most people would agree that the UK is the hardest country to apply the directive to...

Thank you wiggsy for your reply. So basically, the authority can not refuse visa due to the reason of financial living?

I am thinking about Germany to bring my parents as I got a nice offer from there.

You do need to show true dependancy of your parents on yourself... IE living with you, regular financial transfers ETC... its not a simple case of "They will now be dependant"...

Dependency is a question of fact. A person cannot claim to be dependent on another person, who is barely managing to keep his/her head above water.

Also see Reyes

Also see AP Paragraph 35.

Even though a large part of AP has been overturned by SM india, there is not evidence that the views expressed in Par 35, are not valid, and cannot be considered.
