I applied the EEA2 in sep 2008 as a non EEA family member unmarried partner and than HO issued the resident card on oct 2010 which will expired on oct 2015.
my question is can i apply the EEA4 in oct 2013 or need to wait for oct 2015.

2 years cohabitation (which doesn't count towards the 5 years), Your 5 yrs start RC issued date

If you were married then 5 yrs counting start the day you married not the day RC issued

so sorry to say OCT 2015
