EEA 2 refused.

Dear all,I applied EEA 1 and 2 dated 11/10/12, HO received 12/10/12.
COA received 7/12/12 with right to work,and after long wait today I received a refusal letter and HO claims that EEA national is not a qualified person and the company is acknowledged as Dormant company.

EEA national registered a new company in march 2012 as a sole director.

Here are the documents submitted with the application.

Companies business bank statement from may 12 to oct 12.(6 months)
Dividend vouchers 6 months.
National insurance bill issued dated 01/10/12.
EEA nationals personal bank statements 6 months.
Few invoices.
Both passports (EEA national and non EEA national)
Marriage certificate.
Utilities bills on both names.

I have a right of appeal but within 10 days.
Your advice will be valuable for me before going on appeal or reapplication.
HO returned EEA nationals passport but kept non EEA nationals passport.

Probably should appeal, and make a new application or apply for reconsideration in tandem.

IS the company not register in company house. -

Dormant company means that the company is not trading or not doing any business.

If there is no business then why HO ignore business bank statements.

I thing appeal and reconsideration is the best options.

Do both.

thanks for reply.Company is registered in the companies house.Ho sayin that this is noticed the company is registered in the companies house but in hmrc record this company is dormant company.hence this office is not satisfied with the documents.

Quite odd. Fool dont like to be corrected, so asking them to reconsider may be like knocking ones head against a brick wall.

Proceed with the appeal, as the decision is clearly wrong.

Proceed appeal and re consideration and fill ct141(I thing ct14 or ct42) form and sent to hmrc so they can remove dormant company tag as soon as possible.
