Child status

Dear all
I need your kind advice about one of my relative . She is a sister of an Eea national. She got 5 year resident card as a family member of Eea national. Her 5 year will complete next year.she lived together with her cousin who does not has leagal status in uk and she has a uk born child with him. So please tel me about that child immigration status in the uk. I am waiting for your kind reply.

Your relative can't pass her right to anyone as she herself isn't an EEA national. If the child is hers, then the child will become a British citizen when she obtain her PR.

Thanks. Could you please tel me that can she get child benefit and child tax credit for her child?

@OP, your question can be read in a number of ways.
Who is the EU national? Who are the family members of the EU national? Who's obtained residence documentation?

how many people are we talking about.
EEA National
Your Relative: EEA's Sister
Relative's Child
Relatives Cousin (Childs Father)
Is this correct?
Relative is in the UK as the dependant of the EEA and has one year till PR.
Child is in the UK as the dependant of the relative - and their status is therefore legal.
However: Cousin i have no idea about.
The fact that the child will become british when mother gains PR is incorrect. but it will also gain PR after five years of residing in the country legally under the EEA regs (as the dependant of the mother, as long as the mother is dependant on a qualified EEA / gains PR and no longer requires to be dependant ETC).
