Help please

A friend of mine comes from Bulgaria, they came to the UK in 2004 and worked for 2 years on a business Visa self employed until the end of 2006 when Bulgaria became part of the EU, they then started employment with a UK coffee chain and worked there from 2006 to 2010, in 2010 changed employers, recently after a Border Agency visit there employer is now asking for a Certificate to prove they have right to work however they have never needed this as they was exempt, they are now saying if they have no certificate they may have to terminate there employment, any Advice would be much appreciated?

The border agency website says if you have worked legally for a period of more than 12 months you do not need a Accession work card or Certificate to work in the UK.

That 12 months employment must be on a category that allow unrestricted employment and in your case the business visa holder can only work for his own business. See below some FAQS:
