EEA3 Application - CSI requirement

Hello Everyone,

I am an Italian, migrated to UK with my family on August, 2009. Since then I have exercise my treaty rights as a full-time under-graduate student.

I have get married on 2012 and my non-EU husband has been obtained his EEA2 after few months. Few months before he made his application, I bought a Comprehensive Sickness Insurance (CSI) after being aware of the requirement. I didn't have any insurance cover before that.

I am planning apply for my EEA3 visa in September, 2014. However due to absence of CSI from 2009-2012, will I get my EEA3 in 2014? or Do I have to wait for constant 5 years with the CSI as a Student?

Not to forget my husbands application has processed successfully with my current condition.

There is a concession: Did you apply for a RC using EEA1? If you were issued a RC on the basis of being a student, and this happened before 20 June 2011, you will not be refused. Otherwise, yes, you will be refused.

Alternatively, if you can provide an Italian EHIC or a letter from the health authorities in Italy that you were covered during those years, that would be accepted as CSI.
