Permanent Residance - EU Law

Hi Guys,

I have a couple of questions, but first I give you some background info.

I am a non EEA national, living in the UK for last 8 years. 6 months ago I got residence card (EEA2 Form) on the basis of my durable relationship with my GF who is from Spain. My GF is living in the UK for 5 years now and she always has exercised her treaty rights so I assume that she is eligible for the PR. Our relationship is 4 years old as of today:) My questions are:

1) If she applies and receives her PR, will this accelerate my PR? I mean, I have to be on this residence card for 5 years to be eligible for the PR but if she becomes the permanent resident of the UK, will this help me achieving PR earlier than current 5 years timescale?

2) If she goes for British nationality after 12 months of receiving PR, what would be the situation for me then? as she will be a British citizen at the time and not an EEA national who is exercising her treaty rights (which is the basis of my current residence card).

Please advise as she is considering this currently and we both need to know the outcomes before taking a decision.

Regards,
Jay

It won't accelerate the process to achieve PR for non-eu national except there will be no further need to demonstrate the treaty rights evidences of EU national partner. And if unmarried partner then the time to secure PR will be 5 years from the date of EEA2 RC issuance.
