Hi I would like to know what actually means subject to Immigration Control.

Are non-eu family members residing in uk on chen case, subject to immigration control?

Thank you for the prompt reply, it was really helpful.

So according to CBTM10120, family members of EEA National child are not subject to Immigration control

Correct me if I am wrong please.

Yes, I intend to claim child tax credit, CB and housing benefit. But I do not want to breach laws as it says chen cases are not entitled to benefits.

So was just looking for an answer.

Under Chen you are expected to be self sufficient and not to be a burden on the state by claiming public funds.

Yes, I know that chen cases are to be self sufficient. But my question was whether we are still able to claim benefits?. Because it is not necessary that in a period of 5 years in uk someone will not always be employed. and at some part of time may require state help or funds.

Someone is not expected to be employed all the time but he is expected not to rely on public funds. That's the whole point of self sufficient. Being able to maintain yourself without help.

You should also be aware that the HO view is that DRC doesn't lead to PR (after 5 years) under the EEA Regulations.

Hi Obie, maybe u can help, am a non-eu family member on a 5-yr residence card, do you know if i can claim job seekers allowance, been looking for work for the past 6 or so months but things r tough financially, my partner works but thats his money, just got 4 weeks temporary work but could do with some help till i get a job, do you think i can claim anything or am not entitled?
