Hi guys i hope every one doing good i have quetion that what is
Directive 2004/38/EC?
how does it exactly works ?
actually i,m writing a second complaint about my EEA family permit i applied almost 6 weeks before still waiting for reply i,m just wondering that how i can mention Drictive 2004/38/ec that it can work effectively in my complaine how i can give reference of EU law about directive any links ?
European Parliament and Council Directive 2004/38/EC of 29 April 2004 is about the right of citizens of the Union and their family members to move and reside freely within the territory of the EU and EEA member states.

In theory it is a manual which discuss the issues regarding the rights of EU national and their family members but unfortunately its level of understanding and implementation is significantly varying from person to person and country to country.

Infact it is a law which governs the matters pertaining to European union and its citizens & their family members. And you have full right to complaint under it if the relevant authorities delaying unnecessarily and even can quote the relevant section in covering letter or email while complaining.

I agree with sheraz7, if authority delaying application unnecessary then applicant can officially lodged complaint otherwise under EU/ UK law there are flexibility and provisions if eco/case worker has doubt on marriage or submitted documents authenticity, authority can take extra time to investigate.

I think the directive/2004 chapter must affix atleast on airport walls even along with marketing/advertising stuff there. I wish some non-eu nationals voluntary organization afford its printing and photocopying cost and distribut/affix on airport for everyone's convenience.
