CURIOUS AND HELPLESS OVERSTAYER

A friend of mine has overstayed her student visa for approximately 6 months.She is thinking of " going down "the Surinder Singh route with her British husband.

She is willing to return to her home country Voluntarily on her own expense. Her hubby is ready to do all it takes to get all the requirements for a successful EEA2 visa. In that case, considering she has overstayed and breached immigration rules,what are the chances of her getting the codeA1 stamp AT the port of entry and after a successful EEA2 application?

Overstayed visa won't affect under EU route but non-eu national must have resided together with EU national in another EU state to which EU national does not belong and is working there to meet surinder Singh criteria.

Note that the EU citizen (in this case British) would need to work for several months in another EU member state, e.g. Germany or Ireland. After that the non-EU citizen could return to the UK on the basis of EU free movement law. Check the FAQs!
