EEA Refused, Student Refused, Passport Retained, my options?

Hi Everyone,
I have little bit complicated situation. To start with, I applied for family member of European citizen Visa, which was refused. I appeal against the decision. And meanwhile apply for student visa and withdrew my appeal at the same time.
Unfortunately my visa was refused because my college was no longer on sponsor list. UKBA retained my passport, and they did not give me any right to appeal against the decision.

I still appealed against the decision, which was dismissed. But I appealed again. (Which is in processing at the moment).

Now my question is Can I Marry To European Girl? or I must have to wait till my appeal is decided? Because I dont have my passport and whenever I call the council to ask about marriage they ask my original passport.

I applied for EEA Residence Card as the family member (spouse) of a Romanian exercising treaty rights in the UK.

is it BR5 application form you send as unmarried partner?

When you applied ?

What your ROMANIAN family doing in the UK and how long she is in the UK?

How long you two living together ?

You mess your immigration history.

I don't understand why you applied student visa as your family permit was refused??

What was the reason to do all this?

As per your explained,HO has no doubt that your intention is just to gain UK residencey.

Let us know briefly more about your family circumstances.

Why do you want to marry another EU girl?

Ok lemme explain bit more. When I married european girl. My marriage did not go well so we separated just after six months. Consequently my visa was refused. I did not want to go back without having some proper qualification. So i applied for student visa again. Which was refused because my college was not on sponsor list. Meanwhile i divorced that girl as well.

And why I want to marry again is because, I have a girlfriend, if i go back i dont know they ll give me visa again or not. Or even if they give me how long they ll take for this process. And I dont want to suffer all that pain to applly for visa in my home country.
