Hi all,
I need help with information on how to contact HO for residence card issuance after Higher Tribunal appeal was allowed. Timeline is below.
Applied for EEA2 on 19/01/12
Denied on 19/06/12 (letter was sent to solicitor that failed to pick it up and was thus sent back to HO). I changed solicitor and contacted HO
Re-issued with letter of failed application on 19/12/12 with right of appeal
Appealed 07/01/13
Decision of 10/07/13 allowed appeal at FTTC
HO appealed FTTC decision on 11/07/13
Decision of 10/10/13 allowed appeal at HTTC
HO yet to issue RC.......
All information and advice will be highly appreciated.

Send them a Pre Action protocol letter Asap, if they do not respond within the 14 days required, apply for claim at the Upper tribunal, that's the only thing I can suggest to be effective against this evil bunches.

Where do I send that to? I suppose it must be the Liverpool address. Dalebutt could you kindly post here if you know the address?

Can anyone that waited for issuance of RC for more than 8 weeks comment of this thread please? It is of high importance that I contact HO asap but information on who to contact and where is also crucial at this stage. I will appreciate comments on emails and address from folks that have been through the same situation. Many thanks

No you cannot send it to that email, you should use this address below, it must be on the letter or else UKBA will not accept the letter as valid,
Judicial Review Unit
UK Border Agency
Lunar House
40 Wellesley Rd
Croydon CR9 2BY
you can send it by post or by email to
UKBAPAP@UKBA.gsi.gov.uk, it should contain information about you that the UKBA can help to identify you, you should give them a date which you expect them to reply, UKBA are expected by law to reply within 14days of receiving the letter.
Just to give you a head start , you can start with something like this;
This is in relation to the aforementioned application. The purpose of this letter is to comply with the judicial review Pre- Action protocol. I also would like to give your office time to reconsider its position in the handling of my case, and respond in a way that either makes the propose claim unnecessary or peg down what is in dispute. Details of proposed ground of claim have been set out below.
This is just my idea I am not a lawyer or something, but we've had to pick up few legal bit because of this sort of situation. After 14 days if they didn't respond, you should proceed with the claim at the UTT.

Many thanks for that prompt reply. Does it mean that I can thereafter make a claim (monetary) against UKBA at the UTT? Because in actual fact, I have not been able to work for quite a while now and would have expected them to speed things up after the appeal was allowed but it's the other way round...slow and unresponsive.

The claim I am referring to is the judicial review claim, of course if you can prove that you have suffered monetarily in this maladministration, the court may well award a claim.
