WRS registration

Hi good people.

I know there is probably many similar questions but I will ask again.
I am EEA member and I know WRS was abolish from 30.4.2011 but was there any period in employment during which I didn't have to register for employer? I mean if I was working part time for 2-3 weeks and then finished. Or if I worked for one employer, then left for few weeks, started again for the same one but only for 3 weeks and have same Tax register number. Did I have to register with WRS again?

Another question is if I had gap in UK fro 8 months because I was studying back home but I visited UK for that 3 weeks and worked part time. Should I mentioned that work time?? Or even should I mention that 3 weeks here? What is your opinion?

you asking same question again

the law was you must register within 30 days, 2/3 weeks gap not an issue . Home office will never find it out if you send them payslip 6 payslip in 1 year example: jan, march, april, june,aug,oct,dec

8 months outside may be a problem.

I know I was asking before, but I am just looking for way how to get PR without mayor problems.
Like everyone ;)

I will do it as you said, that is not problem then but there is another question about study during that 5 years. What kind of prove I have to have that I was study abroad for 8 months? Just letter from school that is saying I was study there in that time translated to English?

OK. I red that all and I still don't know 2 things.
1st: There is 1 month time to register but what if I lost my job or I left UK within 18 days and I didn't manage to register?

2nd: if 1st scenario is problem and I left UK in 10/2010 to study in my home country (eventually visited UK for 20 days during school holidays in 12/2010 and worked for 18 days without registration, then left to continue with my school) and returned back to UK 06/2011 is necessary to tell them about my 20 days visit in UK? And what should be prove that I was student for that 8 months? Just letter from school confirming my study there translated by registered translator to English?

Generally, absences of up to six months per twelve do not interrupt residence, except for one period of up to twelve months for important specified reasons. See directive 2004/38/ec for details.

Hi,
So I called UKBA ask about time during I don't have to register with WRS and about time which I was outside of UK for study. Unfortunately person I was speaking with didn't know anything. :(
Not even what should be prove of study.

All,

My wife is an EU national (A8 National), she started working in the UK March 2010, she sent her WRS application soon after but HO misplaced the Employment letter and in September 2010 my wife sent them again new employment letter(from same employer). She did not hear anything back from the HO at all and also she had holidays so she went back home for couple of months over Christmas/New year period. SHe arrived in the UK Feb 2011 and found new job, whilst she was in process of applying for WRS again it was certain that the arrangements will be lifted off from April 2011, so she didn't applied for WRS, however when she had to sponsor me (non eu national) she received Registration Certificate (for EU nationals).

Now, I would like to know when exactly her residence period starts? Mar 2010 or April 2011 ?? and also when's the best time to apply for her PR? Mar 2015 or April 2016?

Hi, so I spoke with someone from UKBA again and it looks I can use my study in CR for filling gap in 2010 :D

Another question is which date is more important on WRS. Date of issue or Job start date?

Is it big problem?? Because I have every WRS certificate issued 2-3 months after I started new work.
I know I registered as soon as i started but they sent me that certificate very late, so not my fault.

not all if you started work in Aug 2009 but WRS issued Oct 2009 so Oct 2009 is when you legal work started according to UKBA. They won't consider any work prior to registration legal

so i believe it's only the 1st WRS

Hmmmmm. But that means almost all people who applied for WRS will have late date than they started. If someone started 1.1.2009 and sended application 10.1.1009 they issued it 23.02.2009 so that means PR time is counted from 23.02.2009??

I would disagree. If you applied on time (within 30 days) then your legal employment started when you started to work and not the issue date of the WRS. The HO have all the data in their system so I would not worry if you are confident you applied for WRS on time.

I read somewhere long time ago ( UKBA guidance i believe ) that for an A8 national any previous work before WRS registration from 2004 will not count towards PR. Home office never prosecuted anyone but for PR purpose they may count work prior to WRS registration illegal

my friend case:

He ( A8 ) national started working on Nov 2009
send WRS in December 2009.
WRS Issued January 2010

He married a NON EU national in Aug 2010
NON EEA national apply under EU law in October 2010 and she was issued residence stamp for 2 months in November until January 2011

UKBA issued NON EU national 2 month family member residence stamp until January because EEA national 1 year will be completed in January after WRS registration not when she started working in november


You should apply to register with the Worker Registration Scheme as soon as you start a new job. If you do not apply within one month of starting a job, your employment will be illegal after that date. It will be illegal until you are issued with a registration certificate and you may have to stop working.

So I spoke with UKBA and they confirmed that issue date is not important so much because processing time can be up to 6 months which mean if you started work in 1.1.2008 you date of issue can be 1.6.2008 and during this time you probably already worked for 2-3 another employers :-D
Another thing is date which was application posted and that is about that 30 days during which was necessary to apply.

Every time I found some solution I found 2-3 another problems................... :evil:

just to be on the safe side apply on the issue date. and i will only trust a Case worker not an advisor over the phone. They are wrong most of the time.

Whenever/whatever you applied to them they must have record with them. If you can spare to spend few pounds and request your SAR file under freedom of information from them then you can see your record in that report held in their system

If I do that SAR they will show exact date when I sent my WRS application?? How long it take to receive ther answer??
