the law says EEA national should be exercising treaty right for 5 years continuously to qualify for PR

Like another forum member your husband may be very lucky he can apply again EEA4 with CSI and also show sufficient fund ( like joint account ) they may issue him PR. It's more like testing the water if you loose it's just £55

otherwise send new EEA2 application form

also another question which one is best csi - should you have one with excess or preferraby no excess.

i think this thread ..

check here from beginning to end ( OP there didn't have insurance so PR rejected but purchased one and submit new application and it was successful even though it was for very short time not 5 years )

they have only changed for self sufficient EEA national Students

UKBA note:

If you were not asked to provide evidence of comprehensive sickness insurance when you applied for registration certificate, and later apply for permanent residence as a student, your application will not be refused solely on the grounds that there is no evidence of comprehensive sickness insurance on the date of decision

that what i said UKBA only changed the policy for students. For worker it's same from 2006 . But can't tell how the OP ( in the link i shared ) got PR without holding CSI continuously for 5 years as self sufficient
