EEA family memeber to British citizen rights

Hi Everyone,

I need some help regarding my EEA status. I have been on EEA family member status for last 4 years. The first year my visa was valid for one year due to my wife was not registered with WRS for a year. on our second year I was granted for 5 years which expires on 2016 July.

Now I am actually planning to open business in Poland in this year. I am also aware I need to be on EEA2 status for 5 years before I apply for ILR. I dont even know if they are going add on my first year of EEA status when my wife was not registered with WRS - even though it is not applicable anymore. However I have been living in UK for more than 7 years (2 years as a student). In addition, My daughter is British passport holder and she is 6 months old. We are all moving to Poland to establish this business.

now I am really concerned - How would I make sure that I am not going to be stopped If I have to come back to UK in couple of years time. Can I apply for PR right now before I move to Poland? Am i eligible for PR or ILR or parents right? On what basis I can return to UK? Well which I need that.

I will really appreciate your help

very simple

you can apply for PR 5 years after marriage

it seems your EEA family member already a PR holder.

but you have to remember a person may also lose PR by leaving the United Kingdom for more than two years.

Thank you very much !! I guess - Can I basically go away for couple of years with EEA2 status and live outside of UK ?
