Hi, I am Chilean and I am getting married with my British boyfriend, who is also a cypriot national (he was born in england, he has studied here, worked here, everything as a British but his parents are cypriots).
we are having some problems related to the requirents for the spouse visa ( I have posted that in another question in this forum), we were wondering if it would be okay to get married, he being a eu national instead of a british. We know the european law is more flexible, so it would be more convenient . However, we dont know if he could act as a cypriot to get married with me, even though he has been living his whole life as a british.
thank you very much :)

It won't work under the EEA law if he has British citizenship. The UKBA is really strict in how they deal with people who have British citizenship and another EEA citizenship.

The options are:
1) Work in another country (of which he doesn't have citizenship) and then apply to return to the UK under Surinder Singh (a quick search on this board or on Google will yield many more details)
2) Renounce British citizenship and then you apply for an EEA family permit based on his Cypriot citizenship.

I'm sure other people will come on to add more info
