Really looking for advice s for the EEA2

Hello,

I would like to apply for the EEA2 ans here's my situation:

Married to an European national who have been working in the UK almost 1 year before stopping work 1 month before giving birth of twins.
Then she got maternity allowance for 9 months which ended last November 2013.
Since then she tried to get back to her old job because she got a contract in this job. But no answer from her manager.
so now she is looking for a new job and thinking of going to seek jobseeker in job center.

so my questions are:

Is she still holding her right of residence in the UK?
Is it a good idea to apply for the EEA2 under jobweeker way?
Which documents should I submit with my application?

As far as I know it is her legal right to return to work, but yes you can apply for EEA2 under jobseeker allowance.

Yes you are right, but the problem is she tried to get in touch with her manager is order to know her schedule, had send lot of e.mails, calls, but no answers.

it's against the law . Employer can't do this legally

yes you can send EEA2 as job seeker. But make sure not in job seeker more then 6 months

Thanks a lot for your answers, yea it's just 3 months since her maternity allowance finished.

Are you working?

you can send EEA2 application form ( she can be either job seeker, Jobseeker+self sufficient )

You can also send EEA2 application as self sufficient ( she is dependent on you financially )

Personally if similar situation happened to my wife I wouldn't hesitate to sue them for that and even hope for decent compensation. But they know very well that by not responding to your wife they can always excuse themselves that they never received any emails. But if you give up on that it is the reason for people like you why employers feel they can play those kind of games on people. They know exactly what is required of them by law. Why don't you write a formal letter and send it by recorded delivery? or even visit the office yourself and get clarification from them in writing if they refuse to accept your wife back.

Hello,

I wrote to my wife's last job, but still nothing.
And she started a new job 4 days ago in on hotel, but she stopped today because they didn't want to write a contract for her saying that she will get it after 1 month which is bizarre.

So now we decided that she register as a jobseeker with the job center plus. Then I will apply under this status.
Here are the documents that I would like to send, please correct me if there's anything wrong with its.

- I and my wife's passports
- Married certificate
- Our babies birth certificates
- Maternity certificate
- Maternity Allowance confirmation, with the starting and ending date. ( but not pretty sure if I should)
- Proof of address
- Letter from job center plus
- E.mails sended when applying for jobs and the ones from recruitment agencies.

Please give your advises and thx in advance

It's a shame your wife left her job after 4 days, as an employer doesn't have to issue a written statement until the employee has been working for at least one month.

'The employer must provide the written statement within 2 months of the start of employment.'

On eea2 application form still there is an option where employer can sign and stamp to confirm the employment which can be an alternative too if no contract/employer letter/payslips available.

Yea really a shame , because she didn't know abt this and neither me.
In all her previous jobs she got a contract the next day. So all is about ignorance.

Is there any problem if my EEA FAMILY PERMIT finish before the EEA2 application?

I'm really stressed by this, I got only 2 weeks left.

Hello everyone,

I'm really confused about my situation, maybe someone here could calm me down.

My EEA family permit is finishing and my wife still didn't find a new job, and I don't really feel to apply under jobseeker status, because little bit complicated.
So I would like to wait until my wife get a new job to make it easier.

So my questions are:
When applying with expired EEA family permit, will the COA confirm my right to work?

Will I be considered as overstayed?

Let the eea family permit be expired fearlessly and whenever you want can apply eea2 rc. If you wish to apply now then you can make your eea national partner be self sufficient on any saving/income and buy csi. If you send all documents as described on application form then you will receive the CoA with right to work for employer purposes.

Hello guys,

my wife finally got a new job and they gave her a letter confirming her employment.

The problem is now my passport is finishing next Tuesday (25th). I already applied for a new one and waiting for it.

I would like to apply tomorrow with 1 day delivery service.

So my question is

are they gonna accept my application with 4 days left in my passport?

Donot be hurried, simply wait for new passport otherwise caseworker may grant you a RC on A4 sized page instead of stamping it on an expired passport.

Any reason they can find to refuse you they probably will, why don't you just patiently wait for your new passport.I understand your pressured but you don't want your passportpossibly retained that isn't even valid.

Hello everyone!

I would like first to thank all of you who have been giving me information and advices since my Family Permit application until now.

finally I got my new passport and applied for the Residence Card.

Application sent on the 11th April a( royal special delivery) and received on the 15th
Today 24th I received the confirmation letter dated the 16th and the COA dated the 17th with right to work.

Now fingers crossed for the next step RC.
