Dependency EEA

Hi there,

I have applied for a residence card under the EEA 2 application. I have a very specific question on dependency, here is a short story to help understand my situation.

At the age of 19 moved over to the UK in January 12th 2012, I have ever since been living with my mom (EU national). The problem is that my first application had been rejected as we sent in the complete wrong information. Recently moved down to Cornwall and finally got a contract from my moms work to send off with the rest of the documents. Now this is where the problem comes in...

I am now dependent on my mom, and the application says that "For children and grandchildren over 21 and direct relatives in the ascending line: Evidence that
the EEA national family member has sufficient funds to maintain you, and that you are, in practice, reliant on these funds to meet your needs such as for example, bank statements and evidence of money transfers."

I am not entitled to open any account, study or work. That being said I cannot really prove any money coming through as i live under my moms roof, why would she run to the bank and transfer money to me, if she can just give it to me at home.

Now the only proof I have on any form of document is my name on the housing benefit letter they sent to my mom saying i did not bring in proof of employment so they were deducting some. I sent this document with a cover letter stating all i had was that letter and local nhs letter sent to the same address. I also sent in my previous resident card i obtained in France hoping they would notice its the same person I have been dependent on since.

I also stopped working on my visa expiry date to ensure it wouldn't bite back if I wasn't allowed to work. I sent in both p45 and copy of my NI, stating on the cover letter they have not been in use since the expiry date of my family permit. The reason I done that, was to further prove I haven't been able to work, meaning I would have to rely on my mother for my essential needs, or I would have been homeless for the past year and four months.
