EEA unmarried partner visa Requirement

hi dear sirs/madams
i am living with my Romanian partner since 18 months. i am a Pakistani national and came to uk on student visa. i had given my notice of marriage last year but i did attend. i sent my FLRO application to the Home office and stated that i am seperated from my partner for a few weeks. the home office sent me refusal with a right of appeal and said your relationship is not genuine. but the home office has one mistake that your partner is not EU citizen but she are EU Romanian Citizen. i have sent my appeal to the tribunal and now waiting for the court hearing in 28 August 2014.
i have a few questions in my mind.
1) Can i cancel my appeal can i apply for the unmarried route my two years duration will be fulfilled in July 2014 but my appeal in August
2) what solid documents are required for the durable relationship proof?
( As i have Joint Bank statement joints bill and joint Tenancy agreements)
3)Is 2 years are exact duration or home office will give some months concession?
4)Can i send my partner European Card and birth certificate color Photo copies to the home office along with application?
5) will color photo copied be accepted by home office coz my partner she have lost original ID?
6) How long will be the Visa Duration?
7)which application shall i use for unmarried partner route if i apply through EEA rules?
8)will my european partner need to show any fund, employment, as she is unemployed at the moment?
9) can i use my brother financial support in this case if he give me support?

FLRO application for what. That's under UK immigration route. You should send EEA application. Are you married ? You saying you separated from your partner. I am really confused. Anyway if you want send as a unmarried partner i would say wait 2 years.

YES that's fine

They do give but highly recommend minimum 2 yrs

Yes you can but need to be original not photocopy

No : They will just refuse your application i believe ( i am not sure ). what about her passport?
6) How long will be the Visa Duration?
normally 5 years

Is she registered as job seeker ? How long she is living in the UK and working? when she stopped working ? You can now only apply if she is a Job seeker ( but there are some restriction ) or Self sufficient ( enough funds available to support you / her and evidence of health insurance )
9) can i use my brother financial support in this case if he give me support?
What is your brother immigration status? Legal income will be accepted by UKBA if you applying as a family member of a self sufficient EU national

Thanks for your quick response. i am still a little bit confuse.
i know i should send my application through EEA route. i am not married. i sent my case to the home office that time we were just living together. The reason why i sent my FLRO application coz my visa was getting expiring in last year October 2013 that's why i sent FLRO..
the questions which are still arising in my mind....
1) my partner she have lost her ID and passport but she have color scan copy of identity card and Birth certificate....
can i send her color photocopy to the home office to show them just her identity with my EEA2 application
i heard from someone that i can send but i m not sure i need your advise please in this matter?????
2) my partner she is on jobseeker allowances she just got national insurance number. she never work before in this country. and she dont have any employment history in UK.
will home office accept her as a job seeker allowances.
3) my 2 years duration will be fulfilled in july 2014 but my court hearing is in August 2014
shall i apply as a unmarried in july 2014 or i should wait till august and should go for hearing???
4) you said visa duration will be 5 years but i heard the unmarried visa is for 2 years am i right?

UKBA EEA2 application says " you must send Your EEA national family member’s current passport or ID Card. If they do not have a pass- port or ID card, you must provide another form of identity "
This another form of identify. I don't think it's for you. it's for someone who is at risk " asylum seeker" and they can't produce an ID
Because this your first application or her first application ( EEA1 ) to the Home Office you need an official ID like Passport or National ID

EEA jobseekers will then only be able to claim JSA for 6 months. After 6 months, only those who have compelling evidence that they have a genuine chance of finding work will be able to continue claiming. So if your application takes longer then 6 months UKBA may refuse / want to more what is she doing here in the UK

You can still apply as unmarried partner

Immigration Rules for unmarried partners, that is they require an applicant to demonstrate that they have been living together with their EEA partner in a relationship akin to marriage that has lasted for at least 2 years. Resident card is normally 5 years and it will be like a sticker in your passport

hi dear sirs
i was on tier genenral student visa in uk but my before my visa getting expiring i sent my FLRO application to the home office for further leave to remain through european girl but they have refused it.. i have sent an appeal to the court but my hearing is in september 2014..
i have now decided to marry with a british partner and want to send my FLRM application again to the home office before the court hearing date..
but i have some confusion in my head ,
1.. my British partner she is on income and housing benefits support, will she need to show the 18600 pounds requirement or not.
2.. if she need to show the fund the how many months salary slips should be shown to the home office if she leave the income support ??
3..my one friend was in same situation and he told me that just show 6 months wages slips to the home office am i write??
4..if she want to work and show fund to the home office will she need to work full time or part time?
5..my passport in a home office can i do marriage in a court ?
6..how long is the FLRM processing time?
7.. shall i cancel my court hearing date before sending FLRM or after sending FLRM?
8..how much chances of success in my case according to my situations.??

You are putting yourself in very complex situation. You don't send FLRO you need to send EEA application under european route
If you been refused before why was it refused ?
are you married to that EU lady still or just living together as unmarried partner ? You need to tell us more your immigration history
If you send application under european route and then after it been refused you apply under UK immigration route by marring a british girl uKBA may suspect it's a sham marriage. You've more right and protection under EEA law then UK immigration law.

The minimum income requirement does not apply if the UK-based sponsor is in receipt of Disability Living Allowance, Severe Disablement Allowance, Industrial Injuries Disablement Benefit, Personal Independence Payment, Attendance Allowance, or Carer’s Allowance . I believe UK national is not one of them so YES she need

If the applicant is in the UK (ie both spouse members are in the UK), then both of their income can count. However, the applicant is also required to be with the same employer for more than 6 months or meets the salary requirement with different employers for the past 12 months.

Normally NO. registry won't allow it but you may be successful with driving licence ( may be / may be not ). ASK THEM

I'm getting the words 'marriage of convenience' and I'm sure the UKBA will be thinking the same. I'd worry more about how you might counter that.

thanks for your brief and quick response..
i m not married with a European girl we are just living together since more than 1 and half year.
i sent FLRO application to the home office ans said that we were living together but now separated for a few weeks. you know why i sent my FLRO application coz my tier 4 student visa was getting expire that's why..
the home office refused my application and said like you not living with her 2 years and your relationship and is not genuine and durable. but they give me appeal right. i have sent my appeal to the home office on the basis of human right grounds.
1 i said like my part she is non Muslim and she cant go with me to Pakistan
2 i said my partner she has come back with me and i have attached affidavit from a notary public
3 Pakistan is not safe for non Muslim peoples especially from Europe.
4 i said my parents will not gonna accept her as my wife because she is christian and i am Muslim.
the court have given me hearing date in August.
i m very confused i don't know what to do..
i have find another British born Pakistani girl same my religion and culture and her mum dad sisters and brother and other relatives knows me ... i am thinking to marry with and apply with her for visa and to cancel my appeal.
i have spoke with the registrar office they said bring Pakistani identity card in English and full birth certificate then they can give us notice of marriage date like we can marry in court...
5 if i marry with a British girl which application form shall i use for the visa
6 if she stop claiming income support benefits then how much amount she need to show in 6 months or how much she need to show in month..1x6
7 i m just allowed 20 hours in my previous student status and still i can do 20 hours
is my 20 hour are enough to show to the home office..?
8 could my elder brother support me from Pakistan if he give me his bank statements and wages slip along with a letter..?
9 could her father or mother support her if they give her a letter from business and their bank statements?.

Don't need to cancel hearing
I do not think so . UKBA won't accept photocopy ID for the 1st application. Why can't she apply for new ID or Passport from her consulate in the UK ?

alikhan1234 and adnankhan1234 we do not allow the creation of multiple IDs by the same person (you both have the same IP and thus are the same person).
I have deactivated the later account, if it continues you will be banned and your IP blocked.

I think your case so complicated bcos u dont put such honest information nd u cofused us . But partner cases are si complicated even u proved u lived with her two years still need to convience ukba thts genuine relationdship ..

i really appreciate and thanks to all members for quick and brief reply.
i have one question about the unmarried partner visa require documents..
we have all tenancy agreements, joint statements and joints bills on our names but when we start living together that time we dont have any joint letters she have some letter from acqua credit card agency but i have my phone bill for that period.
we start living together in june 2012 and we dont have any joint bills or letters on our name till February 2013 like 9 months but we have separate bills and letter on our names.
my question is
1..will the home office accept single letters on our names or they need bill and letter on joint names.
2.. what is the strong points for the unmarried partner visa where we can satisfy the home office for the successful application.

There is no right or wrong answer here. If it's 24 months or more then better but UKBA previously accepted even 15 months and on the other hand rejected 4 years
It's all up to you how you convince UKBA caseworker that your relationship is genuine.

16 hours on her part should be enough. There have been some people who have received an RC when their spouse worked for 12 hours. Of course, if you are so worried about this, why not try to find a job with more hours?
Also, your activity is irrelevant to the EEA2 application. The HO only focuses on the EEA national's activities, as they are the one from whom rights are derived.
Another thing: it seems quite comment that applicants who are unmarried partners will receive a short COA which says something like: "we're not able to confirm your right to work at present". You might want to consider how you will deal with that if your employer is asking for proof of your right to work. I don't know how to deal with it. Please search on the forum. I'm sure there are many good comments about this.
