urgent - divorce - how to cancel eea

hi

i'm very troubled and i need your help, i don't know what to do . please help.

i'm in UK, I had an issue with my wife in pakistan and i need to divorce.
The problem is she got the eea family permit approved and the passport back.

-how can i have her eea family permit Cancelled ?
-how to be sure that she cannot come to UK ? (who know what trouble she could do or invent whatever against me)
- do you know if/how we can divorce from UK in Pakistan ?

i tried to contact gerry in pakistan but the system seems to have changed.
i don't know if and how to inform uk border agency.

Sorry to hear you are having problems with your wife.

she has probably been issued with a FP and not an EEA residence card. FP is only valid for 6 months while EEA card is valid for 5 years.

i am not in a situation to advice on what to do but may you can try to resolve the issue or if needed seek a legal advice.

just out of curiosity, i suppose you hold a European nationality and not British , correct?

thanks, yes it's EU citizen ship. i need to get out of it and we didn't live together yet.
it's valid for 6 month but it says you can stay longer if you have the husband working...i feel she was with me to come here, but i can't find a number or contact to inform ukba (in uk ? in pakistan ? where to start...)

Her entry permit is only valid for 6 months and without your input she will be unable to apply for the EEA2/UK Residence Card. So even if she gets to the UK she will not be legally resident there for long.

I hope you can find some degree of compassion to allow her to put her 'house in order' without laying the heavy hand of the law on her. I have no clue what has happened to cause your impatient stance. I hope you can work it out.

hi

the confusion is "eea permit valid 6 month however You can stay for longer than 6 months if you’re related to an EEA national as their spouse". so until i'm divorced she can stay here i guess which can take time...
she's in her family in pakistan so i want to be sure to stay out of trouble. i wish to avoid her coming here without reason and avoid putting any false blame (violence or whatever she wants).
i just feel being victim of a scam and i don't know the potentiel risk/consequences.
right now she could jump in a flight and come and then i don't know what i'm supposed to do if that were to happen (report to police ? but they will say i'm the husband ...)

sending a letter saying that i want to divorce by post, and a copy to ukba, does it have any legal value ?

For divorce normally the marriage must be 1 year old and in uk undisputed divorce takes 4-6 months. I think the way you looks so rush may cause inconvenience to you yourself. If uk English marriage which not registered in Pakistan and having no joint child/wealth has no recognition there so you will yourself have to bang head in walls :lol:
always reconciliation and reconsideration is better because sometimes decisions taking in hurry cause repentance later. Let her come as normal.

You don't want to be married to someone if they're trying to scam you. You'll have to go to Pakistan and divorce her as a UK Talaq isn't recognised.

Send the Home Office an email: Furthernationalityenquiries@homeoffice.gsi.gov.uk. Tell them your situation.

I'm sure they would be more than happy to cancel an EEA family permit so they should help you.

whats the big deal even if she manage to enter the uk .she will need your passport to apply for residence card . you should think all of these things before applying for her visa .its very unlikely that within a few days your feelings got changed for your wife.
she is still your wife .
what happens if you change your mind after while and you want her to be with you in uk .
so think before you leap.
and please sort your family issue between you and your wife . as every married couple have issues in life that does not mean act like a child .give her a chance if still you can not go further she can not force you to have your passport and other documents to send for eea2 .

thank you very much all for your quick reply.
i'm giving thoughts since few weeks but very hard decision. at least i need to know what to do if something's go wrong. will give more thoughts and time. most hard part is to get any valid email as no one really pick the phone or email sent have no reply.

would you know if you can divorce in pakistan FROM uk ? what is the procedure ? (as it's probably long i can't stay there for long as i work)

all started after the application was submitted so very strange.
the big deal in uk are the procedure the grounds and whatever, i'm not familiar with uk laws and it's more easier in pakistan. Plus there are some scam cases so you never know what someone can blame you for, even if it's all false.

There is only was reason for a divorce, an irretrievable breakdown of the marriage, which can be shown in a number of ways, usually unreasonable behaviour, but have to wait at least a year.

However, I'm not sure if this applies to you, a marriage can be voidable (annulled) if you didn't consummate it (you haven't had s e x since the wedding). Though, I'm not sure if this would a reason to annul in Pakistan, you should speak with a family law solicitor.
