Quallifies For EEA3 or NOT

Hello Senior Member's,

My wife wants to apply for Permanent Resident ,she is from A8 EEA country.
1. from sept 2008 to oct 2009 she was studying in university doing her last year of bachelour degree.
2.From april 2009 till now she is still working for same employer, her WRS she applied and issued was march 2010.

During her studies times she had no health insurance , the only thing she had was NHS card.

As above circumstances,simple answer is no.

the problem is this that she did not completed 5 years on WRS.
And i dont know that 1 year of her being student will count in PR , when she was studying she did not had health insurance.

i saw somewhere here that there is a case in Court . and the judgement is pending on that. You might wana keep an eye on that.

under current rules you need to be exercising treaty rights for 5 continuous years and then you obtain PR.
