EEA4 or BC? please help

Hi Guys
I need your helps about my situation.I appreciate for all your response
I am EEA Spouse and my wife is polish origin but let me clarify my story first
We got married and I got my EEA1 Visa in june 2009.And I know this is start of my 5 years period.Then I got my EEA2.Then my wife got her BC. And soon my 5 years period will end in in june 2014(hope I am right?).
So my question is; can I apply for BC directly or will I have to apply for EEA4(Independent visa) and then BC?(as my wife was granted for naturalization)

EEA4 is optional. It provides confirmation of Permanent right of residence (PR) (
15).
You may apply for British citizenship directly when
eligible, after PR is attained (
2).

Hi Vinny thanks for reply.i got it.But as i explained up,my wife got recently citizenship.So then havent i right for BC directly after 5 year.Why should i apply for EEA?

As I said above, EEA4 is optional. You don't have to apply for it if you don't want to.

Sorry to question again again vinny.i just wanted to make sure.
Because i know normally ,to marry with BC as spouse,waiting time is 3 years to have citizenship.But i got 5 yeea2 visa.because my wife was polish. But now BC anymore.so this means i dont wait 1 more year for BC?

That's correct. You may be
eligible from June 2014 (completing 5 years in the UK, after marriage).

If you are sure that i will be definetly eligible,then i can applyfor BC from june 2014 as 3 years already passed.right?thats great.Thanks

Suggest you use the
NCS, so they can check that all the requirements are met.

Attaining PR is just one requirement. There are also other
requirements to meet!

Vinny has suggested you use the NCS, I suggest you take him up on that. If you don't have a PR document you'll need to evidence your right to PR in addition to KoLL and the other requirements.

I have checked the requirments why it say 3 year if marry BC
is it the old law ? I marreid BC 3 years 10 month now can i apply for it ?

Hi Amber; I have all documents for EEA4 and BC.I just want to wait longer if i have right to apply for BC.If my wife got herBC, my 5 year should be reduced to 3 years.It means by 5years waiting time,i could apply for BC.If i want to make sure.Because if i will be refused then i will lose money and stuff like that.
I just want answer,if someone is sure about right answer.

You can not apply BC if you do not have PR or ILR
Because PR is not requirement if you are under EEA law you can apply BC 6 years after living in the UK as family member of an EU national
or 5 years if married to BC

after divorce you are no longer spouse of a British citizen so you can't apply after 5 years. it will be 6 years

that's right the minute you are divorced you are no longer married to British citizen. than normal rules apply.

I thought through and i will go for EEA4 first.Because no body can give any definite prove and i am scared to apply for BC first.Anyway thanks

It's difficult to give a definite response without seeing all the
evidence that you intend to provide. That's why I suggested the
NCS.
