Hello guys just signed up and still trying to get the handle of the site..I got married to my eea partner through customary marriage abroad, we submitted our application for eea2 and was called for an interview but the application was still refused and the Ho gave stupid reason for refusing the application but i was given a right to appeal..However we have just had a baby now and i was wondering if any one could give me any info about the correct form and procedure to apply for a 5 year eea route and have my child as my sponsor..Please guys your contributions would be highly appreciated..

If your child is EU national and you don't want your EU wife as a sponsor then you can apply derivative right of residence, until your child grow up using derivative rights of residence form.

They said that they are not satisfied that we are in a genuine relationship even though my wife was already pregnant by the time we went for the interview, and we mentioned that to them as well..

I have an appeal in July but thinking of applying with my child as well..What form should i use for that? and if successful, do i get a resident card as well?

On what basis would a derivative RC be issued? applying for DRC would not get you far. On what basis was your application refused? I would concentrate on the appeal, a DRC is pointless, I do not even think you will be granted a DRC.

Thank you casa, I had completely missed that. OP concentrate on your appeal, there is absolutely no reason why you should be contemplating another application given the reason for refusal. It is the respondent policy that, she will not suspect a marriage of convenience where a child is involved in the marriage. I do not see why your appeal will fail.
