EEA2 dependant over 21 son

Hi guys
My fiance is illegal here as he was brought in ilegally as a child
Basicly we want to regularise his stay
He was staying with me, but now his dad has come over from the netherlands to support him as he is in a better position to do so.
Can we make an application to show that they are now living together (though haven't before) and he is capapble of looking after his as an over 21 dependant son, or will his past be taken into account?
