10 years long resisence

Hi all
From 2004 - 2008 student visa
2008-till 0ct 2014 eea family member (spouse)
in 21st may 2014 will have 10 years without gaps in uk
Am I qualify for 10 years long residence ILR???

In fact, my was and still exercising her treaty right with gaps, but each year few payslips I am then scare of refusal.

your 10 years ILR would depend on your patner's activities (for the years under EEA Regulations). If you can't count the time for PR (under EEA Regulations), you can't use it for 10 years ILR. Applying for 10 years wont allow you to bypass the issue with her employment gaps.
